This page explains the terms and conditions on which we supply any of the products listed on our website www.scyphus.co.uk to you. Kindly take cognizance of the following terms and conditions carefully before ordering any products from our site. By ordering any of our products, you agree to be bound by these terms and conditions.
1. INFORMATION ABOUT US
1.1 www.scyphus.co.uk is a website operated by SCYPHUS PAPER CUPS © SCYPHUS UK. We are registered in the UK and our registered office is located at 71-75 Shelton Street, Covent Garden, London, WC2H 9JQ. This is equally our business address for all orders and business matters.
2. YOUR STATUS
By placing an order through our site, you warrant that:
2.1.1 you are legally capable of placing such an order on behalf of yourself or another business;
2.1.2 you have authority to place that order if you are representing a company.
3. FORMING A CONTRACT BETWEEN YOU AND US
3.1 Once you ask for a quote, you will receive an e-mail from us acknowledging that we have received your request and providing you with a quote on the desired product(s). However, this does not mean that your order has automatically been accepted as your request for a quote simply constitutes an offer to us to buy one of our products. We will process your order only once we receive the green light from you. All orders are subject to acceptance by us.
4. AVAILABILITY AND DELIVERY
4.1 Delivery can be subject to various factors. Our delivery time is 8-15 working days. We have an Ultra Express option that requires 3 working days and a Standard Express option that requires 4-7 working days. The Economy option is 8-12 weeks. Express shipping is provided on rush orders only or if specified by you: shipping is done within 48 hours of order receipt; overland dispatch generally reaches the destination within the next day.
4.2 If you do not accept delivery of the ordered products or if we are unable to deliver the products following an act or omission on your behalf, you will be liable for any risks and all extra costs incurred including, but not limited to, those arising from storage and delivery thereof. We do, however, provide free storage for bulk orders to allow on-time hassle-free shipping.
5. RISK AND TITLE
5.1 Subject to clause 4.2, the products ordered will be at your risk from the time of delivery.
5.2 Ownership of the products ordered will pass to you only once we receive full payment of all sums due, including delivery charges that apply.
6. PRICE AND PAYMENT
6.1 The price of any products will be as provided to you as a quote, except in cases of obvious error.
6.2 Prices are liable to change at any time. However, the changes will not affect confirmed orders.
6.3 Time for payment shall be taken into consideration. No payment shall be deemed to have been received until we have received cleared funds.
7. OUR LIABILITY
7.1 We guarantee that any product purchased from us is of satisfactory quality within the parameters of the Sale of Goods Act 1994.
7.2 We shall not be liable for a breach of the warranty in clause 8.1 unless you give us written notice of the defect within 7 days of the time when you discover the defect or ought to have discovered the defect. Same conditions apply in the event of non delivery or late delivery that should be notified to us within 3 days of the date on which the products should have been delivered.
8. IMPORT DUTY
8.1 Products ordered from us for delivery outside the UK, they may be subject to taxes or import duties. You will be responsible for payment of any such charges on which we have no control and cannot predict the amount.
8.2 You must comply with all relevant laws and regulations of the country for which the products are destined. We will not be liable for any breach by you.
9. EVENTS OUTSIDE OUR CONTROL
9.1 We will not be responsible for any failure to perform, or delay in performance of, any of our obligations that is caused by events outside our reasonable control (“Force Majeure Event”).
9.2 A Force Majeure Event includes any act, event, non-happening, omission or accident beyond our reasonable control and includes in particular (without limitation) the following:
9.2.1 Fire, storm, explosion, flood, earthquake, subsidence, epidemic or other natural disaster.
9.2.2 Strikes, lock-outs or other industrial action.
9.2.3 Civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war.
9.2.4 Impossibility of the use of motor transport, railways, shipping, aircraft, or other means of public or private transport.
9.2.5 Impossibility of the use of public or private telecommunications networks.
9.2.6 The acts, decrees, legislation, regulations or restrictions of any government.
9.3 Our performance will be deemed to be suspended for the period that the Force Majeure Event continues. However, we will use our reasonable endeavours to bring the Force Majeure Event to a close or to find a solution.
10. LAW AND JURISDICTION
10.1 Orders for the purchase of products from us will be governed by the law in the UK.
